Terms & Conditions — Gaute Dvergsdal Bøyum Mountaingoat Guiding

1. General – These Terms & Conditions (“Terms”) apply to all bookings, purchases and participation in guided tours, courses and other activities (the “Activities”) offered by Gaute Dvergsdal Bøyum Mountaingoat Guiding, Organisation number 913850874 (“Company”, “we”, “us”, “our”) and available via the website https://glacierguiding.no and authorised third‑party booking platforms.

1.2 By booking, paying for or participating in an Activity you confirm that you have read, understood and accept these Terms and any additional conditions in the Activity description, and you agree to comply with all safety instructions provided by the Company or its guides.

2. Definitions 2.1 “Booking” means a reservation made by the Customer and accepted by the Company.
2.2 “Customer” or “You” means any person who makes a Booking or participates in an Activity.
2.3 “Guide(s)” means Company-employed or subcontracted guides, assistants and staff.

3. Booking, confirmation and payment 3.1 Bookings may be made via our website, by email or by authorised booking partners. A Booking is confirmed once the Company issues a written confirmation (email or booking platform confirmation).
3.2 Payment terms: A non-refundable deposit of 30% of the total booking price is required to confirm the Booking. The remaining balance is due 21 days before the Activity start date. If booking within 21 days of the Activity, full payment is due on booking. Accepted payment methods: card or bank transfer as indicated on the booking confirmation.
3.3 Pricing: Prices shown are in NOK and may include VAT where applicable. Confirmed Bookings are charged at the price shown on your confirmation.

4. Deposit, cancellations and refunds 4.1 Customer cancellations: Cancellation charges apply as follows:

– More than 30 days before the Activity: full refund of amounts paid less a NOK 300 administration fee.
– 15–30 days before: 50% refund of the total booking price (deposit retained).
– 7–14 days before: 25% refund of the total booking price.
– Less than 7 days before or no‑show: no refund.

4.2 Rescheduling: Requests to reschedule are subject to availability. Rescheduling more than 21 days before the Activity is free of charge; within 21 days a NOK 300 rescheduling fee may apply.
4.3 Company cancellations and changes: The Company may cancel or change an Activity because of weather, safety or operational reasons. If the Company cancels, we will offer a full refund or an alternative date/activity where possible.
4.4 Force majeure: The Company is not liable for cancellations or delays caused by events outside its reasonable control (e.g., extreme weather, strikes, government restrictions). We will endeavour to offer alternatives or refunds as above.

5. Participant requirements, fitness and age limits 5.1 You must meet the fitness, age and equipment requirements specified for each Activity. Minimum and maximum ages and fitness levels are stated in Activity descriptions.
5.2 Medical conditions: You must inform the Company in writing of any medical conditions, injuries, pregnancy, or medications that may affect participation at time of booking. The Company may refuse participation where a medical condition poses a risk.
5.3 Guides may cancel or remove participants if, in the Guide’s reasonable opinion, they are unfit, impaired by alcohol or drugs, or endanger themselves or others. No refund will be given when a participant is removed for these reasons.

6.Safety, instructions and equipment 6.1 Participants must follow all instructions and directions given by Guides at all times. Failure to comply may lead to removal from the Activity and forfeiture of fees.
6.2 The Company will provide group safety equipment where stated (e.g., harnesses, helmets, crampons). Participants are responsible for the proper use of loaned equipment and for any loss/damage caused by negligence.
6.3 Participants must bring the personal clothing and equipment specified in the Activity description (sturdy boots, warm layers, waterproofs, gloves, etc.). The Company may refuse participation if participants are not properly equipped.

7. Risk, assumption of risk and liability 7.1 Activities occur in outdoor mountain and glacier environments and involve inherent risks including falls, crevasses, avalanches, hypothermia, rapidly changing weather, and remoteness. By booking and participating you accept these risks.
7.2 To the fullest extent permitted by applicable law, you agree that the Company, its owners, employees, agents and subcontractors will not be liable for any injury, loss, damage, or death arising out of or related to your participation except where caused by the Company’s proven gross negligence or wilful misconduct.
7.3 The Company’s total aggregate liability for any claim arising from an Activity is limited to the total amount paid by the Customer for that Booking, except where applicable law provides otherwise.
7.4 You agree to indemnify and hold the Company harmless from any claims, costs, damages or losses (including legal fees) arising from your breach of these Terms, or your negligence or wilful acts.

8. Insurance 8.1 All participants are strongly recommended to hold their own travel, medical, accident and rescue insurance covering outdoor activities and evacuation. The Company’s insurance is limited and may not cover all eventualities.

9. Photo, video and publicity 9.1 The Company may take photographs or videos during Activities for promotion. By participating you grant the Company a royalty‑free, worldwide licence to use such images for marketing purposes unless you notify us in advance. If you do not consent, inform the Guide before the Activity begins.

10. Third‑party services and subcontractors 10.1 The Company may use subcontractors or third‑party providers (transport, accommodation, other guides). The Company remains responsible for the organisation of the Activity but is not liable for failures of independent third parties beyond our control.

11. Complaints and refunds 11.1 If you have a complaint, notify your Guide immediately so we can attempt to resolve it on the spot. If unresolved, submit your complaint in writing to gaute@glacierguiding.com within 14 days of the Activity. We will investigate and respond within a reasonable time.

12. Cancellation by the Company for safety reasons 12.1 The Guide or Company may cancel or alter an Activity at short notice for safety reasons (e.g., changing weather, unsafe glacier conditions). In such cases the Customer will be offered a refund or alternative Activity/date.

13. Privacy and personal data 13.1 We collect and process personal data to manage bookings and provide Activities. Our Privacy Policy explains how we use, store and protect personal data and your rights. GDPR and local privacy law protections apply where relevant. Link to the Privacy Policy here.

14. Intellectual property 14.1 All content on our website and promotional materials is protected by copyright and remains the property of the Company or its licensors. You may not reproduce it without prior written permission.

15. Changes to Terms 15.1 We reserve the right to amend these Terms. Updated Terms will be posted on the website and apply to Bookings made after the posting date. Existing confirmed Bookings are subject to the Terms in force at the time of booking unless otherwise agreed.

16. Severability 16.1 If any provision of these Terms is found invalid or unenforceable, that provision shall be severed and the remainder will continue in full force.

17. Governing law and jurisdiction 17.1 These Terms are governed by the laws of Norway. Any disputes arising from or connected to these Terms will be subject to the exclusive jurisdiction of the Norwegian courts.

18. Acceptance 18.1 By confirming a Booking you (on behalf of yourself and any participants you book for) acknowledge you have read and accept these Terms.
